侵犯商业秘密罪罪过形式探析
A Probe into Offence Forms of the Crime of Infringing Trade Secrets
【摘要】 从罪刑法定原则出发,侵犯商业秘密罪在主观方面包括过失。但是,这种立法模式违背刑法的谦抑性,而且造成法条内部相互冲突,应对其进行修改。
【Abstract】 According to the principle of a legally prescribed punishment for a specified crime,crime of infringing trade secrets in-cludes negli gence in subjective aspect.How ever,this legislative mode violates the modesty of criminal law and causes conflicts a-mong le gal clauses,thus it should be amended.
