论抽象行政行为可诉的现实范围
The Actual Extent of Litigating Abstract Administrating Actions
【摘要】 根据需要与可能相统一的原则,在我国的现实条件下,并非所有的抽象行政行为都适宜提起行政诉讼。规章及规章以上的规范性文件不宜诉。规章以下的规范性文件是抽象行政行为可诉的现实范围。
【Abstract】 administrating actions are suitable for proceeding under the present conditions of Chin a.Regulations and the normative documents above regulations are not suitable w hile the normative documents below r egulations are within the extent of p ro-ceeding.
