【摘要】 本文用经济分析的理论和方法 ,对经济犯罪进行了分析 ,认为 :经济犯罪相对于传统犯罪 ,犯罪人一般都是以谋取非法利益或者以非法占有他人财产为目的 ,犯罪人更关注犯罪的成本与收益 ,因此通过提高经济犯罪的犯罪成本来防范经济犯罪的发生不失为一种良策。提高经济犯罪的犯罪成本 ,可采取一系列措施 ,本文仅从经济制度建设、立法、司法的角度寻求提高犯罪成本的途径和措施 ,包括 :加强制度建设 ,增大犯罪直接成本 ;提高司法效率 ,直接增大犯罪惩罚成本 ;严密法网 ,完善刑罚 ,间接增加犯罪的惩罚成本。更多还原

【Abstract】 This paper analysis economic crime by economic theories and means. Compared with traditional crimes, the purpose of this kind of crimes is to get illegal interests or illegally occupy other people’s property. The criminals pay more attention to costs and benefits of criminal behaviors. As a result, they always maximize profits of criminal behaviors. Based on this analysis, we suggest that we take good measures to fight and prevent economic crime by increasing the cost of criminal behaviors. There are three main measures of increasing the cost of criminal behaviors: (1) increasing direct cost by perfect laws and rules; (2) increasing indirect costs by improving enforcement efficiency; (3) increasing punishment costs by penalty.更多还原
