【摘要】 “市场结构———市场行为———市场绩效”分析模式是反垄断法规制方式的理论依据。西方国家的垄断基本上是市场垄断,其反垄断法的规制方式有一个从“结构主义”到“行为主义”转变的过程。目前,我国的垄断主要是行政垄断,反垄断法的规制方式宜采取“结构主义”并侧重于打破行政性市场壁垒。但从长远看,随着我国市场经济体制的完善,反垄断法的规制方式也会从“结构主义”向“行为主义”转变。更多还原

【Abstract】 The model of “Market Structure-Market Conduct-Market Performance”is the theoretical basis of the regulatory way of the antimonopoly law.The main form of monopoly in the western countries is market monopoly and the regulatory way of the antimonopoly law has changed from “Structurism”to“Conductism”.At present,the main form of monopoly in China is government monopoly, so “Structurism”concerning the government obstacles should be taken.But when developed market economy system is formed,the regulatory way of the antimonopoly law in China will also turn from“Conductism”to “Structurism”.更多还原
