【摘要】 本文通过对世界贸易组织关于服务贸易法律制度的研究 ,探讨了现行中国旅游服务业法律体系在“入世”的背景下所面临的严峻挑战 ,进而提出了中国旅游服务业当前所应进行的几项法律建设内容 :尽早建立起完整的旅游服务贸易法律体系 ,制定《旅游法》;根据 WTO规则补充、修订和完善现有的旅游服务立法 ,使之提高到 GATS框架下承诺的水平 ;依据 GATS有关尊重各国政策目标、照顾国家发展水平的原则条款 ,争取有序开放的环境和条件 ;促进相关领域自由化进程与旅游业开放的同步协调发展更多还原

【Abstract】 This paper, while studying WTO’s legal system concerning service and trade, discusses the tough challenge China is facing about the legal system of tourism service prior to the entry into the World Trade Organization. The paper, furthermore, offers the reflexions regarding the formulating of some laws in the field of tourism. They include: Building as early as possible complete legal system regarding tourism service and formulating “Tourist Law”. In light of WTO’ s rules, revising and perfecting the existing legislation about tourism service so as to reach the level of commitment within the framework of GATS. In accordance with the GATS aims of respecting different countries and the principles and provisions of taking into account the developing level of different nations, striving for the environment and conditions for orderly opening-up. Promoting the process of openness in the related areas and the coordinated development of opening to the outside world in the tourist industry.更多还原
