【摘要】 迁徙自由是公民一项不可剥夺的基本人权，此项权利不仅为世界各国宪法所确认，也为《世界人权宣言》和《公民权利与政治权利国际公约》所确认。宪法对公民迁徙自由的规定是指公民具有自由择居和自由出入国境的自由，国家为维持公共秩序和保障国家安全可以在不违背宪法自由精神的前提下制定法律对之加以必要的限制。我国现行宪法没有规定公民的迁徙自由有其历史和经济方面的因素，在建设社会主义法治和市场经济条件下，宪法重新确认公民的这一权利是十分必要的。更多还原

【Abstract】 Freedom of residence change, a basic human right that can not be deprived citizens of , is confirmed not only by the Universal Declaration of Human Rights, but by international Covenant of Civil and Political Rights. The constitutional stipulation of citizen residence change means citizens have the freedom to choose residence place and to depart from and enter a country, while the state, for the purpose of maintaining public order and ensuring national safety, can restrict it by legislation, provided that the constitutional freedom is not violated. China’ s constitution in force does not stipulate it, which is of historical and economical factors. While building socialist government by law under market economy, it is necessary for the constitution to confirm the freedom.更多还原
