【摘要】 对修订后的《婚姻法》中离婚制度进行了再探讨,认为离婚制度的法定条件“感情确已破裂”不符合我国的婚姻状况,并建议将其改为“婚姻关系确已无法维持”,文章还探讨了新《婚姻法》增设的离婚损害赔偿制度,认为这既是加强社会主义法制的需要,又是维护社会稳定,保护当事人合法权益的需要,并提出了再进一步完善此制度的若干设想。更多还原

【Abstract】 The author manages to have a further study on the system of divorce in the revised Law of Marriage. The author thinks that legal precondition-a genuine breakup of emotion isn’ t in agreement with the present situation of marriage in China, and can’t reflect innate character of marriage. Therefore it is necessary to have it revised into the statement that there is no way to maintain the relationship of marriage .Furthermore, in the article is discussed the newly - added system of compensation for damage clone by divorce. In her exploration, she thinks it is necessary not only for the sake of reinforcing socialist legal system, but the safety of society and legal rights of parties involved.Finally, the author puts forward some suggestions to perfect it further.更多还原
