试论环境犯罪危险犯的类型
Sutdy on the Types of Potential Damage Offense of Environmental Crime
【摘要】 处罚环境犯罪危险犯是世界环境刑事立法的趋势 .本文通过对刑法学上危险犯类型的分析 ,探讨了环境犯罪危险犯的三种类型 ,即环境犯罪具体危险犯和抽象危险犯 ,环境犯罪故意危险犯和过失危险犯 ,环境犯罪自然人危险犯和法人危险犯
【Abstract】 It’s been a legislative tendency of world’s criminal laws to penalize the potential offence of environmental crime.This paper will take into discussion the three types of potential environmental offence through analyzing it:the abstract and concrete potential offences,the negligent and deliberate potential offences,the offences of natural and legal persons.
