【摘要】 随着“入世”及西部大开发进程的加快 ,公害问题将日趋严重 ,公害犯罪极待重新认识。本文认为 :应将公害犯罪界定为环境犯罪和危及公众人身财产安全的有害制品的犯罪 ;我国相关现行立法尚存在较大缺陷 ,应从设计思路、体系、内容方面加以完善 ;在目前情形下 ,司法实践中首先要坚持罪刑法定原则 ,并在此基础上 ,对公害犯罪从重适用法律。更多还原

【Abstract】 The increasing offence of public hazards is bound to follow the rapid advance of entering into ’WTO’and development of west Chinese.Therefore,offence of public hazaras must be understood again.The author suggests that offence of public hazards ought to be defined as crime of environment and crime about various harmful products.Our legislations related to it still have many defects.So the legislation must be perfected from many ways such as thinking,design,system,and extent.But now,judicial pensonnel must firstly stick to the principle of a legally prescribed punishment for a specified crime.Secondly,on the basis of the principle,more severe provision can be applied.更多还原
