后现代法学:为法治探索未来
Postmodern Jurisprudence:An Inquiry into the Future of Rule by Law
【摘要】 西方后现代法学的发端是从后现代主义哲学理念和方法进入法学和法理学开始的。面对 2 0世纪后半叶以来西方法律传统的危机 ,后现代法学向现代法学的基本理念发出挑战 :否定理性个人作为法律主体的存在 ,否定对于法律发展的乐观描述 ,否定法律的普遍性意义 ,否定法律中立的原则。在此基础上 ,文章论述了后现代法学比较成型的三个主要流派 (女权主义法学、法律与文学运动、批判种族主义法学 )的理论倾向和方法特征。文章提出 ,应当认真对待后现代法学 ,因为它不乏针对现实的深刻而犀利的见解 ,不乏提出新问题和新思想的勇气 ,因此 ,它不仅仅是叛逆 ,也是在为法治探索未来
【Abstract】 The author points out that Western postmodern jurisprudence began when the ideas and methods of postmodern philosophy entered the science of law and jurisprudence. In the face of the crises that have confronted the Western legal tradition since the mid 1900s, postmodern jurisprudence has challenged the basic concepts of modern jurisprudence. It denies the existence of rational individuals as legal subjects, and negates the pessimistic description of legal development, the universal significance of the law, and the principle of legal neutrality. The author discusses the theoretical trends and methodological features of the three main schools of postmodern jurisprudence: feminist jurisprudence, the law and literary movements, and critical racial jurisprudence. The author suggests that we should give serious consideration to postmodern jurisprudence, since it contains profound and incisive views on reality, and has the courage to propose new questions and new concepts. It is not simply a rebel, but also represents an attempt to inquire into the future of rule by law.
