【Abstract】 This paper,from the angle of property theory ,analyses the disadvantages of farmland system of China and makes a careful study of the present practice of institutional innovation.Based on evaluation some suggestions are put forward :firstly,further clarifying the definition of property right of farmland use right and establishing a village based and township planned farmland property system to reinforce and stablize farmland contract.
