【Abstract】 The consent on torts is one the important defenses on torts , which renders the possibility that the actor could be excused from the damage upon the victim, or abate the actor’s liability. There must be four prerequisites before it comes into effect. There are three different opinions on the basis of this theory: sound defense, abandon of the right, fault on the victim. The writers hold that the consent on torts is a sound defense rather than a dissolution excuse. Concerning its basis aspects such as freedom of the actor, abuse of rights, balance of interests, value of law should all be taken into account.更多还原
