【摘要】 宪政中的程序即宪法程序 ,是宪政建设的重要组成部分。宪法程序是外在价值与内在价值的统一 ,其内在价值意味着宪法程序具有不依赖于外在目的或程序结果进行价值评判的独立性。宪法程序构建模式有两种 ,即严格规则模式和正当程序模式。结合我国宪政建设的实践 ,当前的宪政建设应在正当程序模式基础上优先发展宪法程序更多还原

【Abstract】 The procedure in the constitutionalism is the constitution procedure, which is one of the important components of constitutional construction. The constitution procedure is the unity of the external value and the internal value. Its internal value means that the constitution procedure is of value judgement independence from external purpose or procedure result. There are two constitution procedure structure patterns: strict regulation pattern and legitimate procedure pattern. Present constitutional construction should give priority to the development of constitution procedure on the basis of legitimate procedure pattern.更多还原
