【摘要】 儒家法律思想自孔子以后分为两支 ,分别以孟子、荀子为代表。孟子侧重继承发展孔子的仁学 ,推行仁政 ;荀子侧重继承发展孔子的礼乐 ,主张礼治。这一结论 ,是从法的起源 ,法的基本价值 ,法的实施方法和预防犯罪四个方面进行比较研究的结果更多还原

【Abstract】 Confucian Legal Thought after Confucius had split up into two branches,which respec tively take Mencius and Xunzi as representatives.Mencius laid particular emphasis on inheriting and developing Confucian study of benevolence,and practising the policy of benevolence,while Xunzi concentrated on developing Confucius’ etiquette terms,and proposing the policy of etiquette ruling.This paper expects to compare the legal thought of Mencius and that of Xunzi in four as pects:the origin of law,the fundamental value of law,enforcement of law,and preventive mea sures against crimes.更多还原
