【摘要】 我国现行《商标法》中“撤销”注册商标制度有两种不同的含义。其一是对商标权人严重违法行为的一种处罚 (制裁)方式 ;其二是对商标瑕疵注册 (或称不当注册、违法注册 )行为的补正措施。两种“撤销”制度适用的条件、程序和法律后果均有所不同 ,在司法实践中应当予以注意更多还原
