【摘要】 目的：通过对某省１９９５年至１９９７年省、市（地、州）、县三级医疗事故鉴定委员会所受理的３０８例案件全面的调查，分析该阶段医疗纠纷发生情况、动态变化、处理现状和发展规律。方法：回顾性调查。结果：该阶段医疗纠纷呈逐年递增状态，技术事故多于责任事故，外科涉及的纠纷所占比例大，实际赔偿远远超过《医疗事故处理办法》规定标准，法院裁决又明显高于前者。结论：国家应尽快制订和完善与社会发展相适应的有关法律、法规、政策，理顺鉴定及处理关系，使我国的医疗事故处理走上法制化轨道。更多还原

【Abstract】 Asaretrospectresearch,thisarticleinvestigates308caseofdealingmedicalmalpracticeacceptedbythecommitteeofmedicalmalpracticeappraisalin1995to1997,andanalysesreasons,changesandorderlinessofmedicalmalpracticeoccurs.Thestudyshowsthatthecasenumberincreasedbyyear,technicalaccidentismorethanresponsibilityaccident,therealcompensationaremuchhigherthanstandardwhicharecurrentlyoneffectandcourtverdictismorethanrealcompensation.Theauthorsuggeststhatthegovernmentshouldlaunchandimprovethelawsandregulationsadaptedtosocialdevelopment,andmakethedealingmedicalmalpracticeworkunderthelegalsystem.
