论我国医师告知义务免除的法律规定的缺陷及其完善
On Deficiency and Complement in Laws and Regulations to Exempting Doctors’ Obligation of Informed Consent in China

【摘要】 医师在实施医疗活动时必须履行告知义务,但是为了最大限度地保障患者的权益,在某些特殊情况下需要免除医师的此项义务。本文探讨了我国现有的对医师告知义务免除规定的不足,论证了解决现存问题的理论依据,并提出了相应的建设性意见。
【Abstract】 Informed consent is one of doctors’ obligations in medical treatment. Ensuring patients’ rights and interests mostly, this obligation need to be exempted in some special cases. This article studies the insufficiency in our existing regulation on exempting doctors’ obligations. To solve this problem, it also lists constructive suggestions based on existing theory.
