【摘要】 研究目的:分析城乡建设用地增减挂钩中土地权利变化,土地增值及其来源,各利益主体的收益,为合理分配土地收益与增值,保障集体与农民权益提供理论依据。研究方法:理论分析与实证研究。研究结果:荆门市东宝区在项目实施中,各利益主体土地收益及土地增值分配差异显著,地方政府获得了较高比例的土地收益和全部的土地增值;农民集体的土地发展权移转及价值未得到认可和体现。研究结论:明确项目实施中政府职能,建立城乡建设用地增减挂钩项目的利益公平分享机制;按照土地权利变化和土地发展权内涵,明确土地增值来源和分配原理,有利于项目实施中土地收益和增值的公平分配。更多还原

【Abstract】 The purpose of this paper is to analyze of the land rights changes,incremental value and its source,income of the different interest subjects in the process of increase and decrease connection of urban and rural construction land,and offer the theoretical basis for the rational distribution of land incremental income and the protection of the collective organization’s and peasant’s rights.The methods of theoretical analysis and empirical research are employed in this paper.The results indicate that in the process of the project implementation,the differences of land income,incremental value and distribution are obvious in the different interest subjects in Dongbao District of Jingmen City,the local governments have obtained higher proportion of land income and all of the land incremental value.It also shows that,the farmer’s and collective’s land development rights transfer have not been recognized,the farmers and collective organizations have not shared development right’s value.It is conclusions that explicit functions of the government,to establish the fair sharing interests mechanism in the projects implementation.Furthermore,according to the changes of land rights and connotation of land development rights,clear the source of land incremental value and distribution principle,it is helpful to equitably distribute land income and incremental value among farmers,rural collective economic organizations,governments all levels,as well as land developers.更多还原
