对专利丛林困境解决之道的思考——从其成因的视域出发
Resolutions for the Patent Thicket Obstacles ——From the Perspective of the Causes

【摘要】 在全球专利数量日益增长的今天,专利制度对创新的激励作用已并不是绝对的正相关,特别是专利丛林所带来的困境直接导致专利系统对创新激励效用的降低。专利丛林的困境日益严重,特别是在新技术的研发及实施成本、专利行政机构审批专利、累积性技术行业的创新这几方面尤为如此。究其根源在于专利丛林的三大成因,即复杂技术的出现、技术领域专利密度的扩增、专利授权初衷的偏离。鉴于此,本文在结合其他国家的现有做法以及相关学者观点的基础上,提出从利用专利局收费机制的杠杆作用调整控制企业的专利行为、适度提高专利授权门槛、控制累积性技术领域专利数量增长这三个维度来给出解决方案。
【Abstract】 In this global world with increasing amounts of patents, the patent mechanism and innovation incentive is no more in absolute positive correlation, especially the obstacles which brought by patent jungle directly lead to degradation of how patent mechanism stimulates innovation. The patent thicket obstacle is getting more serious, especially in new technology research and development and implementation cost, patent authorities review and approve patents and sequential technology industries’ innovation. The root lies in the three causes of patent thicket, e.g. the appearance of complicated technology, the amplified density of patent in technology field and the deviation from the original intention of patent authorization. Given this, this article bases on the existed practices in other countries and some relevant scholars’ opinions, provides the resolution scheme of utilizing the patent office’s charging mechanism which serves as a leverage to adjust and control the enterprises’ patenting behaviors, properly improve the patent authorizing conditions and controlling the patent amount in accumulative technology field.
