【摘要】 合理管控农地非农化对于实现土地资源可持续利用具有重要意义。本文基于土地发展权内涵和移转的主要形式,采用演绎推理与实证分析相结合的方法,运用补偿原理、讨价还价理论和土地供求规律,分析地票和异地耕地补充交易中交易价格和土地发展权的归属问题,提出了公平交易价格形成机理。结果表明,为保护耕地和优化土地空间配置,实现土地增值的公平分配,我国应设立土地发展权,明确土地发展权属原土地所有权人,并适时建立跨省的交易市场;在农地非农化过程中,土地发展权移转交易应保证农地发展权的出让人除了获得土地开发复垦成本和相应的土地价值损失的补偿外,还应分享移转所带来的土地增值。更多还原

【Abstract】 It is a great significance of controlling the farmland conversion reasonably for the sustainable utilization of the land resources. The methods of deductive reasoning and empirical analysis were used which based on the connotation and the transfer form of the land development right. We put forward the mechanism of fair transaction value by applying compensation principle, the bargaining theory and land laws of supply and demand, and analyzing the belongings problem of transaction value and land development right in land indicators and land supplement in different place. Conclusions can be listed as follows.1).Our country should establish the land development right and clear the ownership of land development rights,and establish the transaction market across the province timely. All above measures can be contribute to protect the cultivated land and optimize the land space configuration,and realize the fair distribution of land increment.2).The transaction of land development right transfer should guarantee the transferor not only getting the cost of land reclamation and the compensation of land value loss, but also sharing the land increment which generated by it in farmland conversion.更多还原
