【摘要】 发达国家与发展中国家在生物技术和遗传资源方面各有所长,但因种种原因,二者在生物技术知识产权保护方面时有冲突。为了国际社会的和谐发展与南北经济的共同繁荣,知识产权国际保护的价值取向应该重新定位,生物技术知识产权保护应有合理尺度。发达国家应善意履行《生物多样性公约》,保护人类生存与发展的基础――遗传资源,同时发展中国家也应逐渐适应并努力影响知识产权保护的游戏规则,并为遗传资源的可持续利用及生物技术研发做出贡献。更多还原

【Abstract】 The developed country and the developing country have themselves’ advantages in both biotechnology and the genetic resources. But some conflicts accrue in the area of the intellectual property protection of biotechnology sometimes because of some reasons. The value trend of the international protection of the intellectual property should be reoriented. The developed country should perform CBD out of good will and protect the basis of the survival and development—genetic resources. At the same times, the developing country should adapt and influence the rules of the intellectual property protection and take their contribution for the sustention utilization of the genetic resources and the developing of biotechnology.更多还原
