【摘要】 本文论述了环境保护法的修改的必要性,指出现行环保法的缺陷及不足,如:环保法立法目的和指导思想落后、内容偏重于污染防治而轻视自然资源的保护、基本制度不合理、以及环保法体系的结构还不完整。并提出修改中应着重解决的几个问题,包括:立法目的、基本原则、基本制度(增设生态效益补偿费制度、改革三同时制度、限期治理制度和排污收费制度)、及完善现有的环保法体系。更多还原

【Abstract】 This article indicated the necessity of modification and defection environment protection law. For instance, legislation goals and the guiding ideology are backward, and the content overweighs prevention and cure of pollution while ignores protection of nature resources, and then basic institution is not reasonable, and then its system is also not intact In the light of this phenomenon, the author pointed out that there are several problems to be solved: legislation goals, basic principle, basic institution, (adding to ecology benefit compensation fee system, reforming “three meanwhile system”, harnessing in deadlines system, pollution charges system), and perfecting the existing environment protection law system.更多还原
