我国环境纠纷诉讼遇到的问题及建立环境诉讼制度的思考

【摘要】 针对环境纠纷的诉讼是不同于民事诉讼和行政诉讼的一种专门的诉讼。现在我国法律制度对于环境纠纷的诉讼都是采用民事诉讼和行政诉讼的方式,因此环境纠纷在审判机关进行诉讼的时候会遇到很多难以解决的问题,文章阐述了行政机关和司法机关遇到的问题,并设想建立环境公益诉讼制度来解决环境纠纷诉讼的问题。更多还原

【Abstract】 The environment dispute lawsuit is a kind of special lawsuit which is different from the civil action and the administrative proceedings. Today using the civil action and the administrative proceedings ways to solve the environment dispute in our country, therefore environment dispute carrying on the lawsuit in the judicial organization could meet a large number of questions which are difficult to be solved. The article formulated many questions, met by administrative organ and the judicial organ ,and conceived that establishing a environment public welfare lawsuit system to solve the environment dispute lawsuit problem.更多还原
