【摘要】 自然保护区立法问题在我国理论界、实务界早有广泛的讨论,但一直未形成基本共识;全国人大环资委组织起草的《自然保护地法》(草案征求意见稿)与《自然保护区域法》(征求意见稿草案)的先后出台,有关争议似乎显得更为扑朔迷离;文章基于对自然保护区建设与管理理论和实践的认识,结合两草案稿的框架安排,就新立法的理念、模式、名称、定位、调整范围及基本制度范畴等诸问题再做探析,希有助于澄清某些认识,克服当前自然保护区立法中的部分思维障碍。更多还原

【Abstract】 The nature protection area legislation question has the widespread discussion in our country theory, the solid service early, but has not formed the basic mutual recognition. "Natural conservation Law" (draft manuscript of soliciting opinion) and "Natural conservation Region Law" (draft manuscript of soliciting opinion) organized to draft by environment national resources commission of the National People’s Congress successively appears, and the related disputes seem to appear more confusingly. Based on theory and practice understanding of nature protection area construction and management and combined with two drafts manuscripts the frame arrangement, the article discuses problems about New legislation idea, pattern, name, localization, adjustment scope and basic system category, in order to clarify ideas and overcome some thought obstacles of nature protection area legislation.更多还原
