【摘要】 在民用航空领域,飞行事故难免发生;但对于人为的重大飞行事故应当尽可能地预防并减少其发生,这是人类发展航空业相伴而生的永恒而正义的命题。通用航空是民用航空的重要组成部分,目前,伴随着我国通用航空的快速发展,通用航空飞行事故也在增加,重大飞行事故罪在通用航空领域的适用问题凸显。德国刑法学家费尔巴哈构建的心理强制说认为,试图犯罪的人不管它具有何种犯罪的精神形成源,由于面临着刑罚的威吓,就会因该种威吓而不敢实施犯罪,从而达到国家预防犯罪发生的目的。可见,旨在抑制和预防通用航空飞行事故的发生,有效适用重大飞行事故罪、对责任人科以刑罚意义重大。更多还原

【Abstract】 The flight accidents inevitably occur in civil aviation,so it’s a eternal and justice proposition to prevent or reduce the risk of the artificially flight accidents with the developing of aviation industry.Nowadays,with the fast-developing of general aviation,which is an important part of civil aviation,there is an increasing number of accidents occuring every day.Therefore,the problem of the application of the crime of causing a flight accident in general aviation becomes prominent alone with this fact.The German penologist Feuerbach,whose core of theory of criminal law is the "theory of psychological Compulsion",point out that no matter what kind of criminal psychology the man who wants to commit a crime has,he or she would dare not do it facing with the intimidation of punishment by law,so that the country achieve the aim of crime prevention.It is thus clear that to prevent or reduce the risk of the flight accident in general aviation,analysing the application of the crime of causing a flight accident in general aviation is very significant to our society.更多还原
