【摘要】 通过凤凰事件解读我国风景资源法治现状中的普遍问题。指出存在门票调整违反法定程序,门票取费制度的政策矛盾,门票价格构成不合法.将景区整体作为特许经营内容从而将管理权与经营权混淆.风景被地方政府"先占"并视为"土地财政"等诸多表象问题。其深层原因为国家对风景资源社会属性和使用特征认知不足、风景资源国家所有权制度缺失、基于自由行政裁量的地方政府资源管理水平低下。应通过法律明确风景资源国家所有权及产权制度.同时确立公民享有优美风景为一种法定权利,方可保障风景的公益利益。更多还原

【Abstract】 Interpretation of common legal problems on scenic resources in China through the Fenghuang fee event.This paper points out there are problems such as,the adjustment of entrance fee violates the legal procedures,policy conflicts on entrance fee system,the illegal ticket price composition,the wrong concession content makes the management power substantial replaced and functioned by concession rights,scenic resource is "pre-empt" by local government and taken as "land finance".This paper analyses the underlying reasons as the misunderstanding of social character and use feature of scenic resources,lack of state ownership on scenic resources,and the low level of local government resource management based on administrative discretion.The paper suggests that state ownership on scenic resources and a legal right of citizens freely enjoying scenic resources should come into rules of law,therefore to protect public interests of scenic.更多还原
