【摘要】 权利冲突隐含着知识产品的外部性及其产权的再配置问题。知识产权的初始配置始终是不完全的,随着知识产品价值的增加,不断增强的外部性要求内部化,突破权利的初始格局,进行权利的重新配置。知识产品外部性的内部化,扩展了权利保护的客体与范围,使原来相容并存的权利变得相互排斥,权利冲突由此而生。权利冲突反映了法定权利与道德权利、实有权利与应有权利之间的紧张关系。解决权利冲突的有效方法是,奉行"外部性优先"的原则,将权利分配给对增进资源价值的人。更多还原

【Abstract】 The externalities and the reallocation of the intellectual property are replied in the confliction.The initial allocation of the intellectual property rights is incompletely all along.It is decided by the character of social and compatibility of the intellectual products.With increasing of the value of the intellectual products,the stronger externalities inquire to break the initial patters of right,to redistribute the rights,and to enlarge the object and scope of the protection of the right. The internalization of the externalities of the intellectual products definitely cause to confliction and exclusion of the rights which is compatible to each other.The confliction reflects the tense relationship between legal rights and moral rights,between actual rights and should-be rights.The coordination methods should be the principle of "externalities take to precedence of the other right",which allocates the ownership to the people who are valuable to increase resources.更多还原
