【摘要】 渔业行业协会主要是由渔业行政主管部门作为其业务主管单位的行业协会,除了具有同业性、自愿性、非营利性、民间性、自治性等行业协会共有的特征外,还具有会员规模小、经济实力弱、草根性、公民文化意识弱等特征。本文阐述了渔业协会的主要功能和分类,并分析了面临的法律政策问题。国家应制定专门的渔业行业协会条例,行政审批、登记事项的设定和实施应遵守《行政许可法》,尊重协会的自治权,并依法规定政府对渔业协会特殊的财政扶持政策,对渔业协会可依据其行业影响力实施动态管理,但应建立信息披露制度。更多还原

【Abstract】 The industrial associations of fisheries mainly are those associations administered by the administrative department of fisheries.In addition to the major common properties(one-sector, voluntariness,non-profit,non-government,self-government)shared by all industrial associations, they also carry exclusive ones,e.g.small number of members,limited finance resource,low social status and weak consciousness of civil rights.The major functions and classification of fishery associations are expounded;some problems with laws and policy relating to fishery association are analyzed.It is concluded that a specific regulation of industrial associations of fisheries shall be made, that related administrative approvals and register shall be created and carried out in accordance with the Law of Administrative Approval,that rights of self-government of association shall be respected, that special policy of financial support to associations shall be declared in the related laws,and that a dynamic model of administration may be created on the basis of associations influence on fisheries, but the institution of information publicity shall be established by the related laws.更多还原
