【摘要】 社会保障是一个国家社会制度的重要组成部分,尽管各国的理解有所不同,但就其所包含的主要共同点而言,社会保障制度是以国家或政府为主体,依据法律规定,通过国民收入的再分配,对公民在暂时或永久失去劳动能力以及由于各种原因生活发生困难时给予物质帮助,保障其基本生活的制度。纵观各国的社会保障制度,社会保障立法均是由众多法律法规有机组合而成。我国虽然还没制定一部统一、完备的社会保障法,但已制定了一些与社会保障相关的法律法规;贵州省也与全国其他省市一样,正在不断发展和完善社会保障制度。本文以社会保障法相关理论为指导,立足经济落后多民族地区的典型——贵州省的实际,以城乡社会保障立法为研究对象,在调查分析的基础上,提出问题,探讨对策。主要从社会保障法相关理论、贵州省社会保障立法及实施现状、贵州省社会保障立法及实施中存在的问题、完善贵州省社会保障立法的措施以及贵州省社会保障立法中应明确的相关问题等五个方面进行分析论述。更多还原

【Abstract】 The social security law system is one important component of the national social regime.Although different country has different comprehension,the social security law system,when regarding to the main common notion, refer to the system which regard nation or government as the subject and guarantee the basic hving standard of the people who lost labor capacity temporarily or permanently and the people who become impoverished result from all kinds of reasons by the national income redistribution according to the statutory provisions.Take a wide view in all of the countries,the social security law system is compiled organically by many statutes.There hasn’t an unification, complete social security articles in our country,but there has already existed some related decrees in social security law system;As other provinces,the Guizhou province is striving continuously to perfect the social security system. This article tries to introduce some problems and provide the resolutions under the direction of related theories of social security law and on the foothold of Guizhou province’s condition and on the base of analytical survey by regarding the legislation of social security of town and city as research object.It analyzes mainly in five aspects,the related theories of social Security law system,the praclice and problem of the legislation and the implementation of social security in Guizhou province,the measurement to perfect the legislation of social security legislation in Guizhou province,the related problems which should be definite in social security legislation of Guizhou province.更多还原
