美国环境质量标准诉讼及其启示

【摘要】 美国的环境质量标准制度包括标准的制定、修改,标准制定的目的、标准制定的程序以及标准争议解决方式等内容。当公众对标准的制定和修改不服时,可以通过诉讼的形式进行司法审查,这样可以发挥不同主体间的作用。比较而言,我国在环境质量标准方面还存在诸多问题,需要在标准制定和标准诉讼等方面加以完善,以发挥我国环境质量标准在保护公众健康和环境方面的作用。更多还原

【Abstract】 The America environmental quality standard system, including formulation and modification for standards, the purpose and procedures for standards formulation and the dispute solution for standard. When the public are not satisfied with the standard formulation and modification, they can request to judicial review, and this can play a role between different subjects. In comparison, there are many problems in the environmental quality standards in China, we need to be perfect to play to China’s environmental quality standards in order to protect public health and the environment.更多还原
