【摘要】 京都议定书即将到期,后京都时代缔约国义务如何配置成为国际社会争论的焦点。面对日益紧迫的气候恶化问题,消解美国与新兴经济体的僵局,回应国际社会对于平等的呼吁,有必要重新配置后京都时代的缔约国义务。重新解读共同但有区别的责任原则,并以可持续发展原则和风险预防原则为指导,采用平等排放综合指标,创建附件一国家、新兴经济体和其它发展中国家及不发达国家构成的三类缔约国义务配置模型,并建立新兴经济体援助基金,保障公约目标的实现。更多还原

【Abstract】 Kyoto Protocol is about to expire. How to configure the obligation of the parties is becoming the focus of debate in the post Kyoto era. Facing with increasingly urgent issue of climate deterioration, it is necessary to reconfigure the parties’ obligation under post Kyoto to relieve the deadlock between the new economies and developed countries such as USA. In that, it is a good idea to re-interpret common but differentiated responsibility principle and adopt comprehensive equality emissions credit under the sustainable development and the precautionary principle. In order to realize the goal of the convention, the new system of the obligations configuration of parties should be established among the states of Annex I, new economies and non-developed countries, and the assistance fund for new economies should be set up as well.更多还原
