【摘要】 健全配套的法律体系是推进军民融合的重要保证。在对国内外军民融合概念比较的基础上,介绍了美国军民融合思想的背景,梳理了1990年以来美国军民融合的立法现状,将其特点归纳为放松管制扩大民品采购、明确机构加强军地协调、适度融入确保核心保障能力、提高素质加强采办队伍建设、强化采购竞争,发挥市场配置基础作用等9个方面,得出了对我国推进军民融合建设的3条启示,即健全配套的法律体系是推进军民融合的关键、在法律框架下必须有各种配套的政策及实施计划作为支撑、必须建立健全相关机构配合法律法规的贯彻落实。更多还原

【Abstract】 Improving the supporting legal system plays important role in implementing civil-military integration of China. Firstly, this paper compares the concept of civil-military integration between China and the United States, and sorts out legislation status of the United States civil-military integration since 1990s to show the backdrop of civil-military integration of the United States, then gives the author’s views on the United States civil-military integration. Secondly, this paper summarizes nine characteristics for the United States civil-military integration. For instance, deregulation and expansion of civilian procurement, improving the institutions and coordinated development between civilian and military, moderate participation and ensure the core support capability of military, enhance quality of operators, strengthen the procurement competitive mechanism, giving full play to the fundamental role of market forces in allocating resources, protection of small and medium-sized enterprises, maintaining defense technology innovation vitality, adhere to the military guidance, etc. Thirdly, the authors think that improving the supporting legal system plays important role in implementing civil-military integration of China, and there must be a complete set of policy and implementation plan for support under the framework of the law, then the government should establish and perfect the related institution to cooperate with the implementation of laws and regulations.更多还原
