【摘要】 农村土地承包经营权是农村集体经济组织成员对农村集体所有或者国家所有的依法由农村集体使用的土地,通过土地承包合同享有的占有、使用、收益和流转的权利。农村土地承包经营权具有物权性质,属于用益物权,可以流转。法律规定了流转的方式有转包、出租、互换、转让或者其他方式,实践中所采用的转包、出租、互换、转让和代耕等流转方式各有利弊。目前我国土地流转方式更加多样化,采用入股、抵押贷款、土地承包经营权量化为股份,投资成立农业经营公司等方式,政府制定政策措施,不断推进农村产权流转体系建设。更多还原

【Abstract】 "The Right to Land Contractual Management is the right that allows the members of the collective economic organizations in countryside,through a land management contract,to legally occupy,use,make profits of and circulate the lands,which are owned by collective economic organization in countryside or the state and were originally managed by the collective economic organization in countryside.The Right to Land Contractual Management is in the nature of property rights,which is an usufructuary right that can be circulated.There were many forms of circulation by law such as subcontract,rent,exchange,transfer and etc.In the practice advantages and disadvantages existed in the forms of subcontract,rent,exchange,transfer and farming.Currently the forms of circulation are increasing nationwide,new varieties of forms are created,like shareholding,mortgage loans,quantifying the Right to Land Contractual Management into stock shares,agricultural corporations and etc.The government is implementing new policies to advance the establishment of the system of property rights circulation in countryside."更多还原
