【摘要】 伴随着职业化改革,新旧体制不断发生着碰撞,原有的东西依然在起着作用,新的东西就必然会遇到这样那样的问题。其中,在计划经济专业运动队体制下从未涉及的有关运动员与俱乐部之间的聘用合同问题不可避免的产生出了问题,因合同问题而发生纠纷的事例屡次发生。本文首先从合同的主体、客体、权利义务关系等方面分析,明确了我国运动员与俱乐部之间的聘用合同劳动合同的性质,并论述了劳动合同与普通合同的不同。根据聘用合同应当属于劳动合同的判断,结合具体案例,对运动员聘用合同中出现的单方解约问题、合同期限问题进行分析,提出问题,并提出解决问题的建议。更多还原

【Abstract】 Following the professionalization revolution,conflicts between the new and old system are rising.As long as the old system still exists,the new system will unquestionably encounter a variety of problems.In particular,the matter of employment contracts between sport clubs and athletes,which was never an issue under the old "planned economy" system of professional team management,has inevitably become problematic in many occasions nowadays.As a matter of fact,disputes on employment contracts occur quite frequently.This paper started with analysis on the relationships between subjects,objects,rights,obligations and so on,thus clarified the nature of labor contract between athletes and clubs in our country,and discussed the differences between labor and common contracts.According to the judgment that employment contract should fall within the category of labor contract,the current study used actual cases as practical references,specifically analyzed issues on unilateral cancellation of contract and term of contract.These questions were raised and resolutions were proposed.更多还原
