【摘要】 随着互联网技术的发展,依附于网络形成的虚拟财产也在不断增加,与人们的联系逐渐加深,成为现代社会中不可忽视的重要组成部分。然而,由于其独特的性质和复杂的法律环境,网络虚拟财产的继承问题日益凸显,成为学术界和实务界的关注焦点。为了探讨这一领域面临的挑战,并寻求有效的解决方案,本文系统分析了网络虚拟财产继承的现实困境及完善建议。第一章概述了网络虚拟财产的类型。包括账号密码型、信息资料型、数字货币型和游戏资源型四类,并分析了不同理论视角下的网络虚拟财产权利属性的学说观点,涵盖物权说、债权说、知识产权说及新型财产说,并形成本文观点。第二章剖析了网络虚拟财产继承的现实困境。从立法存在的问题、实践操作面临的困境到技术实施层面的制约因素,揭示了当前虚拟财产继承面临的困境。立法上,法定继承无法适应虚拟财产继承的需求、同时未明确虚拟财产具体的继承方式。实践操作中则面临继承人举证责任困难、隐私保护与继承权的冲突,用户协议对虚拟财产的限制。技术实施层面上存在价值评估机制不完善,缺乏统一的电子数据遗产管理平台。第三章聚焦了域外网络虚拟财产继承模式。通过了解美国、德国和韩国的网络虚拟财产继承的模式,为我国构建更加完善的网络虚拟财产继承体系提供宝贵的经验借鉴。第四章提出了网络虚拟财产继承完善建议。在立法方面提出法定继承制度的适应性重构、设计不同网络虚拟财产的继承方案。通过简化继承人举证程序,平衡隐私保护与继承权冲突,协调用户协议中的权利义务关系来提高可操作性。同时要加强网络虚拟财产保护技术,健全价值评估机制,搭建电子数据遗产管理平台。更多还原

【Abstract】 With the development of Internet technology,the virtual property attached to the network formation is also increasing,and the connection with people has gradually deepened,becoming an important part of modern society that cannot be ignored.However,due to its unique nature and complex legal environment,the inheritance of virtual property on the Internet has become increasingly prominent,and has become a focus of attention in both academic and practical circles.In order to explore the challenges faced in this field and seek effective solutions,this paper systematically analyzes the realistic dilemmas and suggestions for improving the inheritance of network virtual property.The first chapter outlines the types of network virtual property.including account password type,information material type,digital currency type and game resources type four categories,and analyzes the different theoretical perspectives of the network virtual property rights attributes of the doctrinal viewpoints,covering the property rights,claims,intellectual property rights and new types of property,and to form the viewpoints of this paper.The second chapter analyzes the reality of network virtual property inheritance dilemma.from the problems of legislation,practical operation of the dilemma faced by the technical implementation of the level of constraints,reveals the current virtual property inheritance facing the dilemma.Legislation,legal succession can not adapt to the needs of virtual property inheritance,but also does not specify the specific inheritance of virtual property.In practice,there are difficulties in the burden of proof on the heirs,conflicts between privacy protection and inheritance rights,and restrictions on virtual property in user agreements.At the technical implementation level,there is an imperfect value assessment mechanism and a lack of a unified electronic data inheritance management platform.The third chapter focuses on the extra-territorial network virtual property inheritance model.through understanding the model of network virtual property inheritance in the United States,Germany and South Korea,to provide valuable experience for China to build a more perfect network virtual property inheritance system.The fourth chapter puts forward recommendations for the improvement of network virtual property inheritance.In terms of legislation,it proposes the adaptive reconstruction of the statutory inheritance system and the design of inheritance programs for different network virtual properties.Operability should be improved by simplifying the heir’s proof procedure,balancing the conflict between privacy protection and inheritance,and coordinating the rights and obligations in the user agreement.At the same time,it is necessary to strengthen the technology for the protection of network virtual property,improve the value assessment mechanism and build a platform for the management of electronic data inheritance.更多还原
