【摘要】 当前,在全球主要国家积极开展央行数字货币研发试行、新一轮数字货币竞赛正在拉开序幕的背景下,国外众多国家央行和金融组织已将央行数字货币跨境支付作为重点研究方向。中国人民银行指出,我国开展央行数字货币研究的目的之一,就是主动与国际社会加强合作,改进和完善跨境支付体系。但由于央行数字货币研究尚处于初期阶段,研究试点工作还主要集中在一国国内进行,央行数字货币在跨境流通领域还存在很多法律问题亟待解决。本文以推动我国央行数字货币顺利实现跨境流通为目标,在系统梳理数字货币概念特征及发展情况的基础上,针对央行数字货币在跨境流通过程中将面临的基础性法律问题进行探讨:一是央行数字货币跨境流通基础性运营规则不明确;二是央行数字货币跨境流通个人信息保护规则不完善;三是央行数字货币跨境流通域外法律保障不到位。经过分析研究并参考国际经济组织和国外主要国家相关做法,探索提出我国央行数字货币跨境流通的法律规制建议:一是加快完善我国央行数字货币跨境流通的国内法律规则体系;二是探索我国央行数字货币跨境流通创新监管路径;三是着力平衡我国央行数字货币个人信息保护与金融监管的关系;四是积极推进央行数字货币跨境流通法律保障体系的国际化构建。本文从国内、区域到国际层面多维度,为我国央行数字货币的跨境流通提出法律保障建议,以期推动数字人民币国际化,破解美元金融霸凌,切实捍卫我国金融主权和金融安全,不断提升我国在国际货币体系规则制定中的影响力,更好地服务新时代我国经济社会发展战略,促进构建平等互利共赢的国际经济新秩序。更多还原

【Abstract】 Currently,in the context of major countries around the world actively carrying out central bank digital currency research and development trials,and the beginning of a new round of digital currency competition,many foreign central banks and financial organizations have regarded cross-border payments of central bank digital currencies as a key development direction.The People’s Bank of China pointed out that one of the purposes of conducting research on central bank digital currencies in China is to actively strengthen cooperation with the international community,improve and improve the cross-border payment system.However,due to the fact that the research on central bank digital currency is still in its early stages and the pilot work is mainly focused on a country’s domestic market,there are still many legal issues that need to be addressed urgently in the field of cross-border circulation of central bank digital currency.This article aims to promote the smooth cross-border circulation of digital currency by China’s central bank.Based on a systematic review of the concept,characteristics,and development of digital currency,it explores the fundamental legal issues that central bank digital currency will face in the process of cross-border circulation:firstly,the basic operational rules for cross-border circulation of digital currency by the central bank are not clear;Secondly,the central bank’s rules for protecting personal information in cross-border circulation of digital currency are not perfect;Thirdly,the central bank’s legal protection for cross-border circulation of digital currency outside the region is not in place.After analysis,research,and reference to relevant practices of international economic organizations and major foreign countries,explore and propose legal regulatory suggestions for the cross-border circulation of digital currency by China’s central bank:firstly,accelerate the improvement of the domestic legal rule system for the cross-border circulation of digital currency by China’s central bank;Secondly,explore the innovative regulatory path for the cross-border circulation of digital currency by China’s central bank;Thirdly,efforts should be made to balance the relationship between personal information protection and financial supervision of China’s central bank’s digital currency;The fourth is to actively promote the internationalization of the legal protection system for the cross-border circulation of digital currency by the central bank.This article proposes legal protection suggestions for the cross-border circulation of digital currency by China’s central bank from multiple dimensions at the domestic,regional,and international levels,with the aim of promoting the internationalization of the digital renminbi,cracking the financial hegemony of the US dollar,effectively safeguarding China’s financial sovereignty and security,continuously enhancing China’s influence in the rulemaking of the international monetary system,and better serving China’s economic and social development strategy in the new era,Promote the construction of a new international economic order that is equal,mutually beneficial,and win-win.更多还原
