【摘要】 社区矫正是把那些犯罪情节较轻,危害较小的罪犯置于社区中进行矫正改造,使矫正对象不脱离社会,最大限度降低犯罪几率,并加快其重新融入社会的进程,全面促进和谐社会建设。社区矫正是政府公共管理的一项重要内容,涉及司法行政、公安、检察院、法院、社会组织以及志愿者等多个部门领域,单一依靠政府部门主导和管理难以发挥社区矫正的应有价值,亟需政府、社会组织以及社区群众和志愿者等多中心主体的力量协同配合,以实现全社会共同教育和监管的目标。因此,以公共管理学这一宏观理论为导向,在治理视域下对我国社区矫正工作进行研究,对提高我国社区矫正水平,完善社区矫正工作具有重要意义。本文通过治理视域,依据多中心治理理论和协同治理理论,通过走访调查、问卷调查对响水县社区矫正工作进行了解,详细分析当前响水县社区矫正主体参与情况、各部门协同治理情况、工作流程运转、监督考核机制以及矫正效果等,发现了响水县在社区矫正管理方面存在多中心治理的参与主体较少、协同治理参与渠道不畅、多中心治理参与主体力量薄弱、社会力量缺位或流于形式等一系列问题,经过认真研究,查找出以下原因:一是社区矫正工作机制不够健全,二是协同治理的各主体权责模糊不清,三是协同治理的各主体专业化水平不足,四是对社会力量的参与缺少激励机制。基于以上四种原因的分析,本文从以下四个方面提出了较为可行的对策:一是营造多中心治理环境,二是构建社区矫正协同治理机制,三是推动各方治理主体能力建设,四是完善政策保障以鼓励社会力量参与。更多还原

【Abstract】 Community correction is the process of placing criminals with lighter criminal circumstances and less harm in the community for correction and transformation,so that the correctional objects do not leave society.Community correction is an important part of government public management,involving multiple departments such as judicial administration,public security,procuratorates,courts,social organizations,and volunteers.Therefore,guided by the macro theory of public management,conducting research on community correction work in China from the perspective of governance is of great significance for improving the level of community correction in China and perfecting community correction work.From the perspective of governance,based on the theory of multi-center governance and collaborative governance,this paper explores the community correction work in Xiangshui County through interviews and questionnaires,It has been found that Xiangshui County has a series of problems in community correction management,such as fewer participants in multi-center governance,poor participation channels in collaborative governance,weak participants in multi-center governance,absence of social forces or formalities,etc.After careful research,the following reasons are found.Firstly,the working mechanism of community correction is not perfect enough.Secondly,the rights and responsibilities of each subject of collaborative governance are ambiguous.Thirdly,the specialization level of each subject of collaborative governance is insufficient.And fourthly,the participation of social forces lacks an incentive mechanism.Based on the analysis of the above four reasons,this paper puts forward feasible countermeasures from the following four aspects.Firstly,create a multi-center governance environment.Secondly,build a collaborative governance mechanism for community correction.Thirdly,promote the capacity building of various governance entities.And fourthly,improve policy guarantees to encourage the participation of social forces.更多还原
