【摘要】 婚姻关系的稳定和家庭的和睦对于个人、家庭以及整个社会来说具有非常重要的意义。然而,在当今社会中离婚率逐年攀升,已经成为一个普遍现象。据统计数据显示,内蒙古东部地区Z旗的离婚率也呈现出逐年上升的趋势,这引发了人们对于离婚问题的深入思考和关注。而离婚冷静期作为一种法律规定的监护期限,在婚姻出现矛盾纠纷、争执不断且难以解决而选择离婚时,为夫妻之间提供了冷静思考的时间,有望在一定程度上降低因冲动、情绪波动而做出的离婚决定。本文通过对Z旗2018年至2023年整体结婚、复婚以及离婚情况整体数据分析的基础上,深入探讨了离婚冷静期对婚姻维持的作用力,以离婚冷静期的立法现状和实施现状为切入点,探究行政社会工作者在离婚冷静期期间具有的角色以及起到的作用。论文运用实证分析法和比较研究法,对我国离婚冷静期在理论和实践层面的具体实践提出了自己的观点。《民法典》第1077条对离婚冷静期这一概念进行了定义,离婚冷静期的性质属于除斥期间,离婚冷静期的适用兼具授权性和强制性。通观离婚冷静期的实施概况,毋庸置疑,成效显著,但同时也存在一定的问题。研究指出,离婚冷静期在保护婚姻稳定的同时,也可能带来个别权利受限的情况,尤其是对弱势群体可能造成的不平等影响予以了关照。综上所述,通过对Z旗实施离婚冷静期的深入考察,不仅为离婚冷静期在不同社会文化背景下的实施提供有益的借鉴,更为行政社会工作在婚姻法实践中的规范化、科学化和人性化提出了明确的建议和趋势预测。在今后的研究中,需进一步深化对离婚冷静期后续效应的追踪,以便考察离婚冷静期在不同地域、不同社会群体中的适应性和影响力。更多还原

【Abstract】 The stability of the marital relationship and the harmony of the family are of great importance to the individual,the family and society as a whole.However,in today’s society,the divorce rate is increasing year by year and has become a common phenomenon.According to statistics,the divorce rate in Z Banner in eastern Inner Mongolia has also shown an increasing trend year by year,which has aroused people’s in-depth thinking and attention to the issue of divorce.As a guardianship period stipulated by law,the cooling-off period for divorce provides time for husband and wife to think calmly when there are conflicts,disputes,and disputes in the marriage and they choose to divorce,which is expected to reduce the divorce decision made due to impulsiveness and emotional fluctuations to a certain extent.Based on the analysis of the overall data of the overall marriage,remarriage and divorce situation of Z Banner from 2018 to 2023,this paper deeply explores the effect of the divorce cooling-off period on the maintenance of marriage,and explores the role and role of administrative social workers during the divorce cooling-off period by taking the legislative status and implementation status of the divorce coolingoff period as the starting point.Using empirical analysis and comparative research methods,this paper puts forward its own views on the specific practice of divorce cooling-off period in China at the theoretical and practical levels.Article 1077 of the Civil Code defines the concept of a cooling-off period for divorce,which is an exclusion period in nature,and the application of the cooling-off period is both authorizing and mandatory.Looking at the implementation of the cooling-off period for divorce,there is no doubt that the results are remarkable,but there are also certain problems.The study points out that while the cooling-off period for divorce protects marital stability,it can also lead to restrictions on individual rights,especially for the unequal impact that may be caused by vulnerable groups.To sum up,through the in-depth investigation of the implementation of the divorce cooling-off period in Z-Banner,it not only provides a useful reference for the implementation of the divorce cooling-off period in different social and cultural backgrounds,but also puts forward clear suggestions and trend predictions for the standardization,scientization and humanization of administrative social work in the practice of marriage law.In future research,it is necessary to further deepen the tracking of the follow-up effect of the divorce cooling-off period,so as to investigate the adaptability and influence of the divorce cooling-off period in different regions and different social groups.更多还原
