【摘要】 《民法典》正式对离婚冷静期作出规定,既是对防止轻率离婚的初步探索,也是为维护婚姻稳定、促进家庭和睦的重要方式,这对维护社会秩序具有十分重要的意义。但是《民法典》对离婚冷静期仅是作出笼统性规定,尚未形成完整的制度体系,加之我国目前对离婚冷静期的理论研究较少,仍有待完善和发展的空间,构建我国离婚冷静期制度任重而道远。本文主要通过对我国离婚冷静期争议较大的问题进行分析探讨,包括离婚冷静期适用范围问题、离婚冷静期期间设置问题、离婚冷静期适用情形问题以及夫妻权利义务问题等,并对域外国家相关制度的规定进行深入研究,从中寻找出可供我国借鉴之处。借此为我国离婚冷静期制度的构建提出具体建议,如明确离婚冷静期制度的适用范围,对冷静期适用期间应当采用“区分设置”,同时规定中止、延长以及排除适用冷静期的情形,对冷静期内夫妻权利义务也应当从人身和财产方面作出明确规定等。在配套制度方面提出制定家事纠纷调解委员会和冷静期后的回访制度等建议。除此之外,在实施冷静期的过程中除了注重保护当事人的利益,也要侧重关注未成年子女的利益,从而取得更好的社会效果。更多还原

【Abstract】 The Civil Code officially stipulates the cooling-off period of divorce,which is not only a preliminary exploration to prevent frivolous divorce,but also an important way to maintain marriage stability and promote family harmony,which is of great significance to maintain social order.However,the Civil Code only makes general provisions on the cooling-off period of divorce,and has not yet formed a complete system.In addition,there is little theoretical research on the cooling-off period of divorce in China at present,and there is still room for improvement and development.It is a long way to go to construct the cooling-off period system of divorce in China.This paper mainly analyzes and discusses the controversial issues of divorce cooling-off period in China,including the applicable scope of divorce cooling-off period,the setting of divorce cooling-off period,the application situation of divorce cooling-off period and the rights and obligations of husband and wife,etc.,and makes an in-depth study of the relevant regulations of foreign countries to find out what can be used for reference in China.In this way,specific suggestions are put forward for the construction of the cooling-off period system of divorce in China,such as clarifying the applicable scope of the cooling-off period system of divorce,adopting "differentiated setting" for the cooling-off period,and at the same time,providing for the suspension,extension and exclusion of the cooling-off period,and clearly defining the rights and obligations of husband and wife in terms of personal and property.In terms of supporting system,some suggestions are put forward,such as establishing a family dispute mediation committee and a return visit system after the cooling-off period.In addition,in the process of implementing the cooling-off period,we should not only pay attention to protecting the interests of the parties,but also pay attention to the interests of minor children,so as to achieve better social effects.更多还原
