【摘要】 在互联网、云计算、大数据、物联网、金融科技以及其他新数字技术的应用迅速发展的影响下,数字经济迅速崛起,从而带来数字服务贸易的激增。本文基于国家“十四五”规划下加快推进服务贸易数字化进程的背景,引入数字贸易规则的视角,从理论和实证两方面探究数字贸易规则对于数字服务贸易的影响。本文首先基于数字贸易规则与数字服务贸易近年来的快速发展,提出本文的研究背景、目的与意义,并对相关前沿文献进行综述;其次,从概念与理论出发,对数字贸易、数字贸易规则与数字服务贸易的相关概念进行介绍,理论分析数字贸易规则对数字服务贸易可能的影响路径,提出数字贸易规则除直接降低交易成本和不确定性外,还可能通过削减数字服务贸易壁垒和缩小监管质量差距对数字服务贸易产生影响;再次,对数字贸易规则与数字服务贸易的出口发展与现状进行数据介绍,对其特征事实进行分析;然后,从实证研究的角度,以经济合作与发展组织(OECD)成员国间签订的区域贸易协定(Regional Trade Agreement,简称RTA)为例,探究RTA中数字贸易规则对于数字服务贸易的影响,并检验相关的影响机制;最后,本文基于前文的分析,提出结论与启示,并对数字服务贸易的发展与数字贸易规则的制定提出相关政策建议。基于理论与实证分析,本文得出以下相关结论与启示:第一,自2001年美国和约旦签订第一个包含数字贸易规则的区域贸易协定以来,数字贸易规则的广度和深度不断加深;第二,数字贸易规则广度和深度对于数字服务贸易都有着显著的促进作用,且存在滞后效应,数据相关条款对于双边数字服务贸易的出口的促进作用最明显;第三,RTA数字贸易规则可以通过缩小两国的监管质量差异、降低数字服务贸易壁垒促进数字服务贸易双边出口;第四,发达国家与发展中国家签订的RTA数字贸易规则对于数字服务贸易的促进作用更为明显,数字贸易规则对于数字服务贸易的影响存在部门差异,其主要影响数字服务贸易中的金融服务、电信计算机和信息服务、其他商业服务以及文化与娱乐服务。本文针对数字贸易规则对于数字服务贸易的影响研究,对数字贸易规则以及数字服务贸易的研究在一定程度上进行补充与完善,为该领域的研究提供新的视角。通过对数字贸易规则的测度,对世界上其他国家及经济体间的所签订的数字贸易规则深度进行比较,这对于加强我国数字贸易规则的设计具有重要参考价值。通过理论与实证分析数字贸易规则对数字服务贸易的影响程度和作用机制,并结合我国发展现状,为我国数字贸易规则框架与体系的建立提供合理的政策建议,有助于为中国未来发展更加广泛以及合理的数字贸易规则提供更加充分的依据,具有较强的现实意义和实践意义。更多还原

【Abstract】 Under the influence of rapid development of the Internet,cloud computing,big data,Internet of Things,financial technology,and other new digital technologies,the digital economy has rapidly risen,leading to a surge in trade in digital services.This thesis introduces the perspective of digital trade rules and explores their impact on digital service trade from both theoretical and empirical perspectives,based on the background of accelerating the digitization process of service trade under the national "14th Five Year Plan."Starting from the rapid development of digital trade rules and digital service trade in recent years,this paper proposes the research background,purpose,and significance of this thesis and summarizes relevant cutting-edge literature.The paper then introduces the relevant concepts of digital trade,digital trade rules,and digital service trade,theoretically analyzing the possible impact paths of digital trade rules on digital service trade.It proposes that digital trade rules may reduce trade barriers and regulatory quality gaps,in addition to directly reducing transaction costs and uncertainties,and that these reductions may impact digital service trade.The thesis then presents data on the development and current situation of digital trade rules and digital service trade,analyzing their characteristics and facts.Using the Regional Trade Agreement(RTA)signed between member countries of the Organization for Economic Cooperation and Development(OECD)as an example,the paper explores the impact of digital trade rules on digital services trade in the context of empirical research and tests the relevant impact mechanisms.Finally,the thesis proposes conclusions and implications based on the previous analysis and offers relevant policy recommendations for the development of digital services trade and the formulation of digital trade rules.Based on theoretical and empirical analysis,this thesis concludes that digital trade rules have been deepening since the signing of the first regional trade agreement containing digital trade rules between the United States and Jordan in 2001.The breadth and depth of digital trade rules have a significant promoting effect on digital services trade,and there is a lag effect.Data related provisions have the most obvious promoting effect on the export of bilateral digital services trade.The RTA digital trade rules can promote bilateral exports of digital services trade by narrowing regulatory quality differences between the two countries and reducing barriers to digital services trade.Finally,RTA digital trade rules signed between developed and developing countries have a more significant role in promoting digital services trade,and there are sectoral differences in their impact,mainly affecting financial services,telecommunications,computers,and information services,other commercial services,and cultural and entertainment services in digital services trade.This thesis focuses on the impact of digital trade rules on digital service trade,supplementing and improving the research on digital trade rules and digital service trade to a certain extent,providing a new perspective for research in this field.By measuring digital trade rules and comparing the depth of digital trade rules signed between other countries and economies around the world,this has important reference value for strengthening the design of digital trade rules in China.Through theoretical and empirical analysis of the impact and mechanism of digital trade rules on digital service trade,combined with China’s current development status,reasonable policy suggestions are provided for the establishment of China’s digital trade rule framework and system.This will help provide a more comprehensive and reasonable basis for China’s future development of digital trade rules,and has strong practical and practical significance.更多还原
