网约工劳动关系认定及权益保护研究

【摘要】 网约工这一新兴的用工模式,其复杂性和多变性使得传统的二元劳动关系框架已经难以适应,不足以准确界定和保护这一群体的劳动权益。为此,通过深入探讨和分析当前我国在司法实践中面临的关于网约工劳动关系的认定问题,揭示了现行法律体系中存在的不足,并指出了这一问题的复杂性及其对网约工权益保护的影响。进一步地,将国内情况与国际先进经验进行比较,分析了域外一些发达国家在处理类似问题时的立法和司法实践。通过这一比较分析,挖掘和借鉴国际上有效的策略和方法,探索适合我国国情特点的解决方案。包括建议完善相关法律法规,引入更为灵活的劳动关系认定标准,以及提倡建立更为公平和透明的劳动体系等。通过这些措施,希望能够为网约工提供更为坚实的权益保护,同时为平台经济的健康发展创造有利的法律环境。更多还原

【Abstract】 The complexity and variability of the emerging employment mode of network contract workers have made the traditional dualistic labour relationship framework difficult to adapt to,and insufficient to accurately define and protect the labour rights and interests of this group.To this end,through in-depth exploration and analysis of the current problems faced by China in judicial practice regarding the determination of the labour relations of Internet-contracted workers,the deficiencies in the current legal system are revealed,and the complexity of the problem and its impact on the protection of the rights and interests of Internet-contracted workers are pointed out.Further,comparing the domestic situation with international advanced experience,especially analysing the legislation and judicial practice of some developed countries in dealing with similar issues extraterritorially.Through this comparative analysis,effective international strategies and methods are explored and learnt,and solutions suitable for the characteristics of China’s national situation are explored.These include recommendations to improve relevant laws and regulations,introduce more flexible criteria for determining labour relations,and advocate the establishment of a fairer and more transparent labour system.Through these measures,it is hoped that more solid protection of the rights and interests of net contract workers can be provided,while creating a favourable legal environment for the healthy development of the platform economy.development of the platform economy.更多还原
