基层纪检监察机关案件审理工作问题及其对策研究

【摘要】 监察体制改革以来,全国各地监察机关运行已近三年多时间。合署办公后的纪委和监察委,称为纪检监察机关。案件审理,是基层纪检监察机关的一项重要工作,目前运转情况如何,遇到了什么亟待解决的问题?笔者作为从检察机关转隶到监察机关的工作人员,具体从事案件审理工作,工作期间,参与审理了多件违纪违法案件和职务犯罪案件,拟结合自身工作经历发现并研究相关问题,提出切实可行的对策,以期对纪检监察机关更好地履职提供有益的帮助,从而进一步推动我国纪检监察事业和法治事业朝着更好的方向发展。本文结合Z县审理工作实践,重点分析审理机构设置、审理人员设置、审理工作情况、处分决定执行情况和移送审查起诉情况,反映纪检监察机关在基层的全面实践,进而指出基层纪检监察机关案件审理工作存在的一些问题:在对被审查调查对象进行量纪时,由于相关规定层次不明,导致实际操作中存在畸轻畸重、不平衡等问题;在留置案件审理过程中,由于程序繁琐,导致实际审理时限异常紧迫,案件审理压力极大;在留置案件未被移送审查起诉的情形下,被审查调查人缺乏具体可操作的救济措施,导致这一上层规定难以发挥实际效用;由于检察机关提前介入,在审理职务犯罪案件过程中,在法法衔接方面案件审理工作所发挥作用有所弱化;审理工作人员专业素质参差不齐;处分决定执行中外部监督滞后且内容泛化,内部监督乏力。最后结合案件审理工作存在的一些问题,从五个方面详细阐述基层纪检监察机关如何更好地开展案件审理工作,包括提升案件审理人员审理水平、完善顶层设计、切实保证审理时间、切实发挥审理工作作用、提升自我监督有效性等等。更多还原

【Abstract】 Since the reform of the supervisory system,supervisory agencies across the country have been in operation for more than three years.The Commission for Discipline Inspection and Supervision Commission after the office is jointly called the Discipline Inspection and Supervisory Authority.Case trials are an important task of the basic-level disciplinary inspection and supervision organs.What is the current state of operation? What are the problems that need to be solved urgently?As a staff member transferred from the procuratorial agency to the supervisory agency,the author is specifically engaged in case trial work.During the work period,he participated in the trial of a number of violations of discipline and law and duty crimes.I intend to find out and study related issues based on my own work experience and propose practical and feasible The countermeasures in order to provide useful help for the discipline inspection and supervision organs to better perform their duties,so as to further promote the development of my country’s discipline inspection and supervision cause and the rule of law in a better direction.Based on the practice of trial work in County Z,this article focuses on the analysis of the setting of trial institutions,the setting of trial personnel,the status of trial work,the implementation of sanctions decisions and the status of transfers for review and prosecution,reflecting the overall practice of disciplinary inspection and supervision agencies at the grassroots level,and then pointing out that the grassroots disciplinary inspection and supervision agencies are handling cases There are some problems in the work: when the subject of investigation is measured and disciplined,due to the unclear level of relevant regulations,there are problems in actual operation such as abnormality,seriousness,imbalance,etc.;in the trial process of the lien case,the actual trial time limit is caused due to the cumbersome procedures It is extremely urgent and the pressure of case trial is extremely high;when the lien case has not been transferred for review and prosecution,the under-reviewed investigator lacks a specific and operational system for applying for national compensation,which makes it difficult for this upper-level regulation to exert its actual effect;due to the early intervention of the procuratorial agency In the process of trial of duty crime cases,the role of case trial work in the connection of law and law has been weakened;the professional quality of trial staff is uneven;the execution of punishment decisions is lagging in external supervision and generalized content,and internal supervision is weak.Finally,combined with some problems existing in the case trial,elaborated in five aspects how the grassroots discipline inspection and supervision organs can better carry out the case trial work,including improving the trial level of the case trial personnel,improving the top-level design,effectively ensuring the trial time,and giving full play to the trial work.To improve the effectiveness of self-monitoring,etc.更多还原
