【摘要】 在充满不确定性的国际社会中,国际法律制度在稳定国际秩序、规范国际关系、塑造国际规则等方面具有重要作用。国家作为国际社会中最重要的行为主体,深刻认识并把握好国际法律制度构建的路径和规律,对于提升国家的制度性话语权和制度创设能力,乃至于协调国家之间的关系和利益,推动国际合作以及维护国际社会的和平稳定和繁荣发展都具有重要意义。大陆架制度作为国际法律制度的重要组成部分,遵循着观念制度化的形成路径,最初由美国通过发布《杜鲁门公告》提出大陆架观念,经历各国在联合国框架内的斗争和妥协,最终成功构建起了大陆架国际法律制度。从现有的相关研究成果来看,缺乏系统分析和总结大陆架国际法律制度形成路径及其规律的研究。基于此,本文以大陆架国际法律制度作为研究对象,以复旦大学唐世平教授的制度变迁广义理论为理论基底,从观念制度化的视角出发,利用比较研究、案例研究、文献研究等研究方法,分析了大陆架国际法律制度的形成过程,考察了大陆架国际法律制度在不同阶段各个国家的政治实践,梳理了大陆架观念制度化的历史脉络。通过上述分析,我们发现:大陆架国际法律制度遵循观念产生、政治动员、争夺规则制定权与制定规则、制度的合法化和稳定化的形成路径;在大陆架国际法律制度形成过程中,经过各种观念持有者的不断博弈,最终美国以创新性观念为引领,以国家利益为核心,以国家实力为物质基础,以博弈技巧为手段,以国际社会的发展方向和世界共享价值观为关照,通过单边行动、国际条约、国际司法判例等方式推动了大陆架国际法律制度的形成。本研究不仅有助于丰富有关创设国际制度的理论研究,而且通过对大陆架国际法律制度形成路径和规律的总结能够为我国参与和引领国际制度的创设提供参考。本文主要分成三部分:第一部分为引言,位于文章的第一章,主要说明了选题缘起与意义、概念界定、国内外研究现状与述评、研究思路、研究内容、研究方法、研究创新与不足。第二部分是正文,共分为五章。第二章总结了大陆架观念产生的过程、特点以及影响大陆架观念产生的因素;第三章总结了大陆架观念持有者展开政治动员的过程、特点及影响因素;第四章总结了观念持有者争夺大陆架规则制定权和制定规则的过程、特点以及影响因素;第五章总结了大陆架制度合法化和稳定化的过程、特点和影响因素;第六章总结了大陆架制度形成路径的规律以及对中国的启示。第三部分是结论。更多还原

【Abstract】 In an uncertain international society,the international legal system plays an important role in stabilizing the international order,regulating international relations,and shaping international rules.As the most important actor in the international community,a country deeply understands and grasps the path and laws of the construction of the international legal system,which is of great significance for enhancing the country’s institutional discourse power and institutional creation ability,as well as coordinating the relations and interests between countries,promoting international cooperation,and maintaining the peace,stability,prosperity,and development of the international community.The continental shelf system,as an important component of the international legal system,follows the path of institutionalization of ideas.Initially,the United States proposed the concept of the continental shelf through the Truman Proclamation.After experiencing struggles and compromises among countries within the framework of the United Nations,the international legal system of the continental shelf was successfully constructed.From the existing research results,there is a lack of systematic analysis and summary of the formation path and laws of the international legal system on the continental shelf.Based on this,this article takes the international legal system on the continental shelf as the research object,and takes the generalized theory of institutional change proposed by Professor Tang Shiping of Fudan University as the theoretical basis.From the perspective of conceptual institutionalization,using research methods such as comparative research,case studies,and literature studies,it analyzes the formation process of the international legal system on the continental shelf,and examines the political practices of the international legal system on the continental shelf in various countries at different stages,The historical context of the institutionalization of the concept of the continental shelf is sorted out.Through the above analysis,we find that the international legal system on the continental shelf follows the formation path of concept generation,political mobilization,competition for rulemaking power,and the legalization and stabilization of rulemaking and systems;In the process of forming the international legal system on the continental shelf,through continuous gaming by various concept holders,the United States ultimately promoted the formation of the international legal system on the continental shelf through unilateral actions,international treaties,international judicial precedents,and other means,guided by innovative ideas,with national interests as the core,national strength as the material foundation,and game techniques as the means,with the development direction of the international community and the world’s shared values as the focus.This study not only contributes to enriching theoretical research on the creation of international regimes,but also provides a reference for China to participate in and lead the creation of international regimes by summarizing the formation paths and laws of the international legal regime on the continental shelf.This article is mainly divided into three parts: The first part is an introduction,located in the first chapter of the article,which mainly explains the origin and significance of the topic selection,concept definition,domestic and foreign research status and commentary,research ideas,research content,research methods,research innovation and shortcomings.The second part is the text,which is divided into five chapters.The second chapter summarizes the process and characteristics of the concept of the continental shelf,as well as the factors that affect the concept of the continental shelf;The third chapter summarizes the process,characteristics,and influencing factors of political mobilization by holders of the continental shelf concept;The fourth chapter summarizes the process,characteristics,and influencing factors of concept holders’ contention for the right to establish rules on the continental shelf;The fifth chapter summarizes the process,characteristics,and influencing factors of the legalization and stabilization of the continental shelf system;Chapter 6summarizes the rules of the formation path of the continental shelf system and its implications for China.The third part is the conclusion.更多还原
