【摘要】 影视解说短视频的制作特性,使得其与原影视作品之间天然存在着冲突,其使用原影视作品画面的行为可能构成侵权。在我国目前的法律框架下,影视解说短视频难以获得合法授权,在认定合理使用上也存在困难,加之,行政监管对于影视解说短视频采取片面打击的态度,一些高质量的影视解说短视频在获得法律保护上陷入困境。由于不同视频平台、不同类型的影视解说短视频各具特点,影视解说短视频质量良莠不齐,不可一概而论,需要针对不同性质的影视解说短视频进行类型化分析,避免出现“一刀切”的情况。由于影视解说短视频在制作时必须引用原影视作品的画面,其与原影视作品是密不可分的。在分析影视解说短视频是否侵犯原影视作品著作权时,首先需要明确影视解说短视频自身的性质与法律属性,评析类、解析类、改编类影视解说短视频由于其在制作时融入了自身具有独创性的表达,因此,可以作为作品受到著作权法的保护。其次,对不同类型的影视解说短视频进行定性后,需要结合我国目前的合理使用相关规定以及司法实践中的判断方法,对不同类型的影视解说短视频使用原影视作品画面的行为合法性进行综合分析。由此可以得出评析类、解析类、改编类影视解说短视频构成合理使用,不侵犯原影视作品著作权人的合法权利;而简介类影视解说短视频则在某种程度上是对原影视作品的“浓缩”再现,不构成对原影视作品的合理使用,该使用行为系侵权行为。最后,通过明确影视解说短视频的属性以及该类短视频构成合理使用的判断标准,以厘清使用行为的合法边界,实现对侵权行为的精准打击,对优质合法的二次创作作品进行保护,鼓励高质量的影视解说短视频作品的创作。更多还原

【Abstract】 The production characteristics of short video narration make it a natural conflict with the original film and television works,and its use of the original film and television images may constitute infringement.Under China’s current legal framework,it is difficult to obtain legal authorization for short video of film and television narration,and there are difficulties in determining fair use,and coupled with the fact that administrative supervision takes a one-sided approach to cracking down on short video of film and television narration,some high-quality short video of film and television narration are in trouble in obtaining legal protection.As different video platforms and different types of short video narration have their own characteristics,the quality of short video narration varies,and cannot be generalized,and needs to be analyzed for different types of short video narration to avoid a"one-size-fits-all" situation.Since short videos of film and television narration must refer to the original film and television works when they are produced,they are inseparable from the original film and television works.In analyzing whether short videos of film and television commentaries infringe on the copyright of original film and television works,first of all,we need to clarify the nature and legal attributes of short videos of film and television commentaries themselves,and short videos of narration,analysis and adaptation of film and television commentaries can be protected by copyright law as works because they incorporate their own original expressions when they are produced.Secondly,after characterizing different types of short video commentaries,it is necessary to combine the current fair use regulations in China and the judgment methods in judicial practice to conduct a comprehensive analysis of the legality of the use of original film and television images in different types of short video commentaries.From this,we can conclude that the commentary,analysis and adaptation of short videos constitute fair use and do not infringe upon the legal rights of the copyright owner of the original film and television works,while the introduction of short videos is to some extent a reproduction of the original film and television works,which does not constitute fair use of the original film and television works and is an infringement of the act of use.Finally,by clarifying the attributes of short videos and the criteria for judging that such short videos constitute fair use,the legal boundary of the use can be clarified,the infringement can be accurately combated,high-quality and legitimate secondary works can be protected,and the creation of high-quality short video works of film and television narration can be encouraged.更多还原
