【摘要】 2021年中央发布了《知识产权强国建设纲要(2021—2035年)》,为我国知识产权事业的发展开启了新纪元。在这个科技飞速发展的经济全球化时代,知识产权作为一种重要战略资源已成为企业核心竞争力的要素,制定并有效实施知识产权战略已成为时代对企业的必然要求。本文聚焦国内集成电路设计领域的H公司,从无到有为其制定了知识产权战略及相应的实施保障。首先,本文基于文献研究对所涉及的相关理论进行了概述,并从集成电路领域的知识产权战略研究、企业知识产权战略的选择与制定研究、企业知识产权战略的实施保障研究三个方面进行了文献综述。然后聚焦H公司,从知识产权的创造、运用、保护和管理四个方面对H公司的知识产权现状进行了客观阐述,并通过深度访谈对H公司在知识产权方面的内部优劣势进行了分析。接着从政策环境、法律环境、外部资源三个方面对H公司知识产权视角的外部机遇进行了分析,并通过分析H公司最主要的两类知识产权——专利和集成电路布图设计专有权的国内态势和侵权风险,论述了H公司知识产权视角的外部威胁。最后,本文基于SWOT分析构建出H公司知识产权战略模式选择矩阵,将H公司的知识产权战略定位在偏重防御的WO型,并确立了H公司知识产权战略的制定原则、总体目标和框架,同时从知识产权创造、运用、保护和管理四方面逐一制定出子战略,并从组织结构优化、制度流程完善和人力资源配置三方面提出了H公司知识产权战略的实施保障。本文的研究对H公司知识产权从业务层面到战略层面的提升以及H公司核心竞争力的提升具有积极意义,本文所采用的研究、分析范式亦对国内集成电路设计领域的其他企业具有借鉴价值。更多还原

【Abstract】 This thesis focuses on H Company in the field of domestic integrated circuit design,formulates an intellectual property strategy and the corresponding implementing guarantees from scratch for it.First,based on the literatures research,the thesis summarizes the related theories and reviews the literatures.Second,focusing on H company,the thesis objectively expounds the current situation of H company’s intellectual properties from the creation,the application,the protection and the management of it.Then the thesis analyzes the internal advantages and disadvantages of H company in terms of intellectual property through in-depth interviews.Third,the thesis analyzes the external opportunities of H company from the perspective of intellectual property from policy environment,legal environment and external resources.And it also analyzes the external threats of H company from the perspective of intellectual property by analyzing the domestic situation and infringement risk of the two most important types of H company’s intellectual properties—patents and exclusive rights of integrated circuit layout-designs.Fourth,based on the SWOT analysis,the thesis constructs the mode selection matrix of H company’s intellectual property strategy,positions the mode of H company’s intellectual property strategy as the defense-oriented WO type,and establishes the formulation principles,the overall objectives and the framework of the intellectual property strategy.Finally,the thesis formulates the four sub-strategies of the intellectual property strategy including intellectual property creation strategy,intellectual property utilization strategy,intellectual property protection strategy and management strategy.The thesis puts forward the implementing guarantees of H company’s intellectual property strategy from optimizing organizational structure,improving institutions and processes,and allocating human resource.The research has a significance for upgrading H company’s intellectual property from business level to strategic level and improving its core competitiveness.The research paradigm adopted in this thesis can also be a reference to other domestic enterprises in the field of domestic integrated circuit design.更多还原
