【摘要】 村民自治权作为一项基本权利,是村民实现民主自治的重要载体,也是实现新农村建设的内在推动力。如何从法律角度保护村民自治权的良性运转是我国村民自治权研究的重点。为了深入探讨我国村民自治权运行中的法律问题,采取规范分析与田野调查等研究方法,通过理论与实践相结合,对我国村民自治权的基本理论及实际运行状况加以分析,发现我国村民自治权运行中存在诸多法律问题,如村民自治规约与国家法冲突、村民自治积极性不足、村民自治权行使程序不规范以及自治权受侵犯时司法救济手段有限,产生的原因在于我国基层行政权对村民自治权的过度干预、村民民主权利意识缺乏以及村民自治法律制度不健全。为更好地实现村民自治权利,维护村民合法权益,促进村民自治权在法治框架下运转,通过引导村规民约规范化、培养村民自治权利意识、健全村民自治法律制度以及拓宽村民自治权的救济手段,从法律角度更好地实现村民自治权利,保障村民自治权的真正落实。更多还原

【Abstract】 As a basic right,villagers’ autonomy is not only an important carrier for villagers to realize democratic autonomy,but also an internal driving force for the realization of new rural construction.How to protect the sound operation of villagers’ autonomy from the perspective of law is the focus of villagers’ Autonomy Research in China.In order to deeply explore the legal problems in the operation of villagers’ autonomy in China,the research methods such as normative analysis and field investigation are adopted.Through the combination of theory and practice,the basic theory and actual operation of villagers’ autonomy in China are analyzed.It is found that there are many legal problems in the operation of villagers’ autonomy in China,such as the conflict between villagers’ autonomy statute and national law,the lack of enthusiasm of villagers’ autonomy The non-standard procedures for the exercise of villagers’ autonomy and the limited means of judicial relief when the autonomy is violated lie in the excessive intervention of grass-roots administrative power in China,the lack of villagers’ awareness of democratic rights and the imperfect legal system of villagers’ autonomy.In order to better realize and safeguard the legitimate rights and interests of villagers,ensure the democratic and legal operation of villagers’ autonomy,and improve the legal guarantee of the operation of villagers’ autonomy,we can better realize villagers’ autonomy from a legal perspective and ensure the real implementation of villagers’ autonomy by guiding the standardization of village rules and regulations,cultivating villagers’ awareness of autonomy rights,perfecting the legal system of villagers’ autonomy and broadening the relief means of villagers’ autonomy.更多还原
