【摘要】 随着中国各项改革的不断深化和经济的快速发展,人们对生活品质提出了更高的要求。然而近些年来,食品安全、药品安全以及假冒伪劣等问题层出不穷,并且使公众对市场监督管理行政执法的公信力产生了质疑。这些问题不仅关系到人民群众的切身利益,而且也维系着社会的和谐稳定,更是展示一个国家正面形象的重要政治因素。市场监督管理局的行政执法作为保障食品、药品以及质量安全的重要手段,近些年虽然取得了很大的成绩,但是还存在着诸多问题。特别是在欠发达地区,具体执法实践中仍然存在这样的问题。朝阳市地处辽宁省西部,属于经济欠发达地区,多年来市场监督管理局为本地市场经济健康发展保驾护航发挥了重要作用。执法部门建立了比较完善的制度,但依然存在着行政执法力量薄弱、执法检查装备落后、行政执法监管缺位等问题,深入探索行政执法的市场监督管理,对于朝阳市的经济发展具有重要意义。本文结合笔者在市场监督管理局工作经验,并对朝阳市市场监督管理行政执法进行问卷调查,结合统计数据分析执法部门在执法实践中出现的突出问题和困难,分析出现这些问题的原因。并通过与欧美发达国家的市场监督管理行政执法部门比较分析,探索出解决和改善朝阳市市场监督管理行政执法难问题的对策和建议,从而为我国欠发达地区的市场监管行政执法工作提供了一些参考。更多还原

【Abstract】 With the unceasing deepening of China’s reform and the rapid development of economy,people have higher requirements on the quality of life.However,in recent years,food safety,drug safety,and counterfeiting have merged in an endless stream.Then the public has questioned the credibility of the market supervision and anagement of administrative law enforcement.These issues are not only related to the vital interests of the people,but also maintain the harmony and stability of the society.They are also an important political factor for demonstrating a positive image of the country.The administrative law enforcement of the Market Supervision Administration,as an important means of safeguarding food,medicine and quality and safety,has achieved great results in recent years,but there are still many problems.Especially in underdeveloped areas,there are still such problems in specific law enforcement practices.Chaoyang City is located in the western part of Liaoning Province and belongs to the economically underdeveloped areas.Over the years,the Market Supervision Administration has played an important role in safeguarding the healthy development of the local market economy.The law enforcement work has established a relatively complete system,but there are still problems such as weak administrative law enforcement,backward law enforcement inspection equipment and lack of administrative law enforcement supervision.It is of great significance to further explore the market supervision and management administrative law enforcement to improve the economic development of Chaoyang City.This paper combines the author’s work experience in the market supervision bureau,and conducts a questionnaire survey on the administrative law enforcement of market supervision and management in Chaoyang City.Combining the statistical data to analyze the outstanding problems and difficulties of law enforcement departments in law enforcement practice,and analyze the reasons for these problems.Through comparative analysis with the market supervision and administrative law enforcement departments of developed countries in Europe and the United States,it explores countermeasures and suggestions for solving and improving the difficult problem of administrative supervision of Chaoyang City market supervision and management,thus providing the administrative law enforcement work for market supervision and management in underdeveloped areas in China.更多还原
