【摘要】 我国特殊疾病医疗期是“医疗期”与“特殊疾病”两个概念的集合,特殊疾病医疗期以劳动者患有法定的特殊疾病为前提,属于医疗期的特殊规定。与医疗期的一般规定相比,特殊疾病医疗期从法律层面明确了劳动者拥有申请延长医疗期的权利,用人单位拥有审批和决定的权利,这一规定更加凸显了医疗期制度的灵活性和利益衡量性。然而,由于特殊疾病医疗期的立法相对滞后且缺乏体系,导致该规定在立法和司法中存在许多问题,如:特殊疾病医疗期的适用范围不清晰,特殊疾病医疗期的长度缺乏明确的计算方式,延长医疗期的程序缺乏可操作性,特殊疾病医疗期内企业负担重。为了更好地发挥我国特殊疾病医疗期的功能,有必要明确特殊疾病医疗期的适用范围,统一特殊疾病医疗期长度的计算,明确特殊疾病医疗期的延长申请程序,减轻企业在特殊疾病医疗期内的责任,理顺劳动者、用人单位和社会三者之间的关系,强调企业责任和社会责任相衔接,更好地保障劳动者的权益。更多还原

【Abstract】 The medical period of special diseases in China is a collection of the concepts of"medical period" and "special disease",and the medical period of special diseases is the special provision of the medical period,which is based on the premise that the workers suffer from the special diseases of the law.Compared with the general provisions of medical period,the medical period of special diseases clearly defines from the legal level that workers have the right to apply for extension of medical period,and the employers have the right to decide on examination and approval,which is more flexible and balanced.However,due to the relative lag and lack of system of legislation for the medical period of special diseases,there are many problems in the legislation and administration of justice,such as:the scope of application of the medical period for special diseases is not clear,the length of medical period for special diseases lacks a clear calculation method,the procedure for extending the medical period is not operable,and the burden of enterprises during the medical period of special diseases is heavy.In order to better play the function of the medical period of special diseases in our country,it is necessary to clarify the scope of application of the medical period of special diseases,unify the calculation of the length of medical period for special diseases,clarify the application procedure for the extension of the medical period of special diseases,reduce the responsibility of enterprises during the medical period of special diseases,straighten out the relationship between workers,employers and society,emphasize the convergence of corporate responsibility and social responsibility,and better protect the rights and interests of workers.更多还原
