【摘要】 信息网络技术的发展、移动智能设备的普及、更加开放的社会风气和公众分享表达观点的需求,共同促进了各类短视频平台的产生,并在近两年来呈现井喷式的发展。随着短视频的兴起,社会公众提出了“短视频是否受版权保护的问题”,知识产权法学学者也对短视频的版权问题展开了及时的探讨。短视频的独创性判断是短视频保护中需要明确的首要问题,在承认短视频可以获得版权保护的前提下对其独创性的探讨在理论和实践中都有重要的意义。短视频本身“短”的特征,加之独创性自身具有一定的模糊性和灵活性,因而对短视频的独创性判断提出了一些挑战,也因此引发了学者们对于短视频独创性认定问题的相关探讨。本文试图通过对短视频的类型化分析,为其独创性的判断方法提供一些参考意见。本文除引言外,正文主要包括四个部分。第一部分以短视频平台为标准对短视频的范围进行了界定,而后重点以制作方式为标准(视频内容的独立程度),将短视频分为原创型短视频和二次创作型短视频。这也是本文的研究起点。第二部分分析了我国版权法意义上作品的构成条件,并提出独创性是短视频可版权性的必要条件和核心要件。本部分将美、英、德三个具有相对完善的独创性标准的国家进行横向对比,并分析了我国现行的作品独创性标准,以期从中得到借鉴,最终指导短视频独创性的判断。基于现行的司法实践,本文第三部分和第四部分分别按照原创型短视频和二次创作型短视频的分类,具体探究了短视频独创性的判断方法。在此基础上,又具体细分为随手摄制型、创作摄制型、直接剪辑型、剪辑演绎型和剪辑汇编型等五种基本类型,根据其所属的类型,判断是否符合独创性的标准。更多还原

【Abstract】 The development of information network technology,the popularization of mobile intelligent devices,the more open social atmosphere and the public’s need to share and express their opinions have jointly promoted the emergence of various short video platforms,which have witnessed blowout-like development in the past two years.With the rise of short video,the public put forward the question of whether short video is protected by copyright.Intellectual property law scholars also discussed the copyright issue of short video in time.The originality judgment of short video is the primary problem of short video protection by law.It is important to discuss its originality under the premise of recognizing the copyrightability of short video in both theory and practice.The short "small" feature of the short video itself,combined with the originality itself has a certain degree of ambiguity and flexibility,so the short video poses some challenges to the originality judgment,which has led to scholars’ discussion on the identification of short video originality.This paper provides some suggestions for the specific method of short-video originality judgment through the unique perspective of type.In addition to the introduction,the text mainly includes four parts.The first part defines the short video range based on the short video platform,and then classifies it according to different standards,including the production method as the standard,the content source as the standard,and the functional content as the standard.This article focuses on the production method as the standard(the degree of independence of video content),the short video is divided into original short video and secondary creative short video.This is also the starting point of this paper.The second part analyses the composition conditions of works in the sense of copyright law in China,and points out that originality is the necessary and core requirement for copyright of short video.This part compares the three countries with mature original standards and their own characteristics horizontally,and specifically analyses the original standards of our country’s works,in order to guide the establishment of the original standards of short video in our country.The second part analyzes the constitutional conditions of the works in the sense of copyright law in China,and proposes that originality is the necessary condition and core requirement of the copyright of short video.This section compares the three countries with relatively perfect originality standards in the United States,Britain and Germany.On this basis,it expounds the originality standards of China’s current works.It hopes to draw lessons from other countries’ experiences and use it to guide China.The third and fourth parts of this paper analyze the specific judgment methods of short video originality.According to the classification of original short video and secondary creation short video,and based on judicial practice,this paper explores the judgment method of short video originality from film and television works and non-independent works.On this basis,the two types of short videos classified in the foregoing are subdivided into five basic types:manual shooting,creative shooting,direct editing,editing and editing,and editing,depending on the type.Determine if it is consistent with minimal creativity.更多还原
