工程建设领域工资支付规制模式及其合法性
Regulation Mode of Wage Payment and Its Legitimacy in the Field of Engineering Construction

【摘要】 为解决工资拖欠问题,工程建设领域进行了多番制度尝试,施行了工资保证金、失信联合惩戒等制度,规制对象、规制主体、规制措施等方面也相应产生变化,构建了该领域的新型工资支付规制模式。目前,针对该规制模式尚缺少体系化认识,其合法性问题也存在一定争议,需结合行政法基本原则探讨。工程建设领域劳动权益保障的缺失以及特殊的分包体制导致原先以命令、处罚为主的传统规制模式出现惩戒性较弱,侧重事后规制的弊端。新型规制模式呈现出两个显著特征。一是该规制模式围绕施工总承包单位形成,施工总承包单位具有规制对象和规制主体的双重身份。二是该规制模式结合了事前规制与信用规制,有效克服了传统规制的弊端。其中,针对施工总承包单位的事前规制以向施工总承包单位课以强制性公法义务实现,而信用规制则让施工总承包单位承担了列入“黑名单”等失信责任。结合行政法基本原则,该规制模式合法性存疑的部分集中于失信联合惩戒制度:部分信用惩戒措施设定依据不明,与立法保留原则相背离;加强监管以及将信息作为行政活动参考两类措施虽未产生权利侵害的效果,但违反了不当联结禁止原则。
【Abstract】 In order to solve the problem of wage arrears,many institutional attempts have been made in the field of engineering construction,such as wage guarantee,joint punishment for dishonesty and so on.At the same time,the regulatory objects,regulatory subjects,regulatory measures and other aspects have also changed accordingly,thus constructing a new regulation mode of wage payment in this field.At present,there is still a lack of systematic understanding of this regulation mode,and there is some controversy about its legitimacy,which needs to be discussed in combination with the basic principles of administrative law.The lack of protection of labor rights and interests and the special subcontracting system have led to the disadvantages of the traditional regulation mode which used to be dominated by orders and punishments,such as weak discipline and emphasis on post-event regulation.The new regulation mode presents two remarkable features.First,the regulation mode is formed around the construction general contracting enterprise,which has the dual identities of regulatory object and regulatory subject.Second,the regulation mode combines the pre-regulation and credit regulation,effectively overcoming the disadvantages of traditional regulation.Among them,the preregulation is realized by compulsory public law obligation to the construction general contracting enterprise,while the credit regulation makes the construction general contracting enterprise bear the responsibility of dishonesty such as being listed in the blacklist.When the basic principles of administrative law are taken into consideration,some doubts about the legality of this regulation mode focus on the joint punishment for dishonesty: some punishment measures are set on an unclear basis,which deviates from the principle of legal reservation;Two measures,strengthening supervision and taking information as reference for administrative activities,did not have the effect of infringement of rights,but violated the principle of irrational-relationship-forbidden.
